Keywords: genetic fingerprint, authenticity of genetic fingerprint,criminal proof.ملخص الدراسة: تعتبر البصمة الوراثية من الاكتشافات العلمية الحديثة في مجال الإثبات الجنائي، وهي أهم وسيلة إثبات علمية كشفت عنها التطورات البيولوجية الحديثة حيث فاقت غيرها من الأدلة الجنائية الأخرى من حيث دقتها وموضوعية نتائجها، وقد أقرت بمشروعية أغلب التشريعات الوطنية والمؤتمرات الدولية والإقليمية، وكشفت التطبيقات القضائية على أن نتائجها تعد دليلا حاسما في إثبات الكثير من الجرائم كالقتل والاغتصاب وغيرها ومع ذلك تبقى مجرد قرينة ضمنية في بعض الحالات التي تتعدد فيها البصمات بمسرح الجريمة مثلا، وقد تبين المشرع الجزائري هذا الاكتشاف من خلال استحداث القانون 16-03 المتعلق باستعمال البصمة الوراثية في الإجراءات القضائية والتعرف على الأشخاص المفقودين أو مجهولي الهوية ومنه تسهيل الإجراءات من خلال تقليص عدد الأشخاص المشتبه فيهم، مع ضرورة الالتزامباحترام السلامة الجسدية والحق في الحياة الخاصة. summary: Genetic fingerprinting is considered one of the modern scientific discoveries in the field of criminal evidence, and it is the most important scientific means of proof revealed by modern biological developments, as it surpassed other forensic evidence in terms of accuracy and objectivity of its results, and it has recognized the legitimacy of most national legislation and international and regional conferences, and judicial applications have revealed that its results are crucial evidence in proving many crimes such as murder, rape, etc. However, it remains only an implicit presumption in some cases where there are multiple fingerprints at the crime scene.
