حمزة أفرنفؤاد بلعابدإشراف الدكتور : بن قردي أمين2024-12-112024-12-112023http://dspace.cuillizi.dz/handle/123456789/330الكلمات المفتاحية: الهيئات الوطنية، مكافحة الفساد، التشريع الجزائري. key words: National bodies, anti-corruption, Algerian legislationملخص الدراسة تمحورت دراستنا الموسومة بالهيئات الوطنية لمكافحة الفساد في التشريع الجزائري حول البحث في أسباب استفحال هذه الظاهرة، والتعرف على مختلف أشكالها وصورها التي تستشري في جميع القطاعات. باعتبار أن الفساد يمثل عائقا كبيرا أمام التنمية والتطور، فقد أقدمت دولة الجزائر على مكافحته من خلال تعزيز منظومتها القانونية والمؤسساتية بإصدارها لترسانة من القوانين في هذا المجال وانشاء هيئات ومؤسسات من شأنها أن تحد من ظاهرة الفساد بجميع أنواعه وأسبابه ، والعمل على كشف جميع المتورطين فيه ومعاقبتهم، غير أن هذه الهيئات بشقيها القانوني والمؤسساتي لم تثبت نجاعتها على أرض الواقع في احتواء هذه الظاهرة والتصدي لها كون هذه القوانين غير مدروسة ولا تتماشى وخصوصية البيئة الجزائرية من جهة، كما أنها لم تعد تواكب التطور الحاصل في عالم الاجرام من جهة أخرى، كما نجد مؤسسات شكلية تفتقر لأي ضمانات تساعدها على القيام بالمهام المنوطة بها ويعود ذلك لعدم منحها صلاحيات واسعة بالإضافة الى عدم تمتعها بالاستقلالية سواء المالية أو العضوية أو الوظيفية. إن ظاهرة الفساد في الجزائر لا يمكن القضاء عليها إلا في إطار وضع استراتيجية محكمة ومضبوطة تهدف إلى إرساء دولة القانون، عن طريق تحديث منظومتها القانونية ومعاقبة جميع المتورطين في قضايا الفساد دون استثناء بالإضافة إلى تفعيل الهيئات التي تم استحداثها، وإقحام مختلف الشركاء الاجتماعيين في مجال مكافحة الفساد، وهذا لن يتحقق إلا بوجود إرادة حقيقية ورغبة جامحة في القضاء عليه. ABSTRACT Our study, titled national anti-corruption commission in Algerian Legislation, focused on researching the reasons for the exacerbation of this phenomenon and identifying its various forms and images that pervade all sectors. Considering that corruption represents obstacle to development and evolution , Algeria has endeavored to combat it by strengthing its legal institutional system by issuing some laws in this field and establishing institutions that limit this phenomenon with all its types and causes and working to punish all those involved in it ; however, this institutions have not proven their efficacy on the ground in containing this phenomenon and confronting it , because these laws are not studied and do not comply with the privacy of the Algerian environment on one hand and they don’t keep pace with the development taking place in the world of crime on the other hand . Also there is a formality institution that lacks any grantees it carry out the tasks entrusted to it, due to the fact that it was not granted extensive powers in addition to not enjoying independent whether financially membership or functional. Corruption in Algeria can only be eliminated with in the framework of developing a controlled strategy aimed at establishing the rule of law by modernizing its legal system, and punishing all those involved in corruption cases without exception, in addition to activating the institution that have been created and involving various social companies in the field of combating corruption This will not be achieved unless there is a real will and an unbridled desire to eliminate on it.otherThesis
