مهدي محمدكداي مليكةتحت إشراف الدكتور : زيوش عبد الرؤوف2026-06-242026-06-242026-06-24http://dspace.cuillizi.dz/handle/123456789/518الكلمات المفتاحية: السلامة المهنية، المخاطر المهنية، قانون العمل، الوقاية، الرقابة الداخلية، مفتشية العمل، التشريع الجزائري Keywords: Occupational safety, occupational risks, labor law, prevention, internal control, labor inspection, Algerian legislation.ملخص الدراسة تتناول هذه الدراسة الإطار المفاهيمي والقانوني للسلامة المهنية في التشريع الجزائري، مع التركيز على مختلف الآليات القانونية الكفيلة بضمان تطبيقها داخل المؤسسة. فقد تم التطرق إلى مفهوم السلامة المهنية وأهدافها الوقائية، وإلى أهم المخاطر المهنية وسبل الحد منها، باعتبارها أساسًا لبناء بيئة عمل آمنة. كما تم تحليل الإطار القانوني المنظم لها من خلال أحكام قانون العمل والتشريعات ذات الصلة التي تكرّس التزامات المستخدم وتحمي حقوق العمال. كما تناولت الدراسة الآليات القانونية لضمان السلامة المهنية، من خلال الرقابة الداخلية التي تمارسها الهياكل المختصة داخل المؤسسة، والتدابير الوقائية المعتمدة للحد من الأخطار، إضافة إلى الرقابة الخارجية التي تمارسها مفتشية العمل بصلاحياتها في التفتيش ومعاينة المخالفات. وقد خلصت الدراسة إلى أن فعالية منظومة السلامة المهنية ترتبط بمدى تكامل هذه الآليات وصرامة تطبيقها لتحقيق الوقاية الفعلية في بيئة العمل. Abstract This study examines the conceptual and legal framework of occupational safety in Algerian legislation, with a focus on the legal mechanisms ensuring its implementation within enterprises. It addresses the concept and preventive objectives of occupational safety, as well as the main occupational risks and mitigation methods, as a foundation for a safe working environment. The study also analyzes its legal framework through labor law provisions and related regulations that establish employer obligations and protect workers’ rights. Furthermore, the study explores the legal mechanisms ensuring occupational safety, including internal control exercised by specialized structures within enterprises and preventive measures aimed at reducing risks, as well as external control carried out by the Labor Inspectorate through its inspection and violation enforcement powers. The study concludes that the effectiveness of occupational safety depends on the integration and strict enforcement of these mechanisms to achieve real prevention in the workplace.Other
