Keywords: Abuse of power, administrative decision, misuse of authority, judicial review, annulment action, administrative liability.الملخص: يُعدّ التعسف في استعمال السلطة من أبرز العيوب التي قد تشوب القرار الإداري، لما له من خطورة على مبدأ المشروعية وحقوق الأفراد، إذ يتجسد في انحراف الإدارة عن الهدف الذي حدده القانون، واستعمال سلطاتها لتحقيق غايات غير مشروعة أو بعيدة عن المصلحة العامة. وقد تناولت هذه المذكرة بالدراسة والتحليل هذا العيب في ظل التشريع الجزائري، من خلال إبراز مفهومه، خصائصه، وصوره التطبيقية، إضافة إلى دراسة طرق إثباته والآثار القانونية المترتبة عليه. سلّط الفصل الأول الضوء على الإطار النظري للتعسف في استعمال السلطة، حيث تم التطرق إلى تحديد مفهومه لغةً واصطلاحًا، وبيان مختلف التعريفات الفقهية والقضائية له، إلى جانب إبراز خصائصه التي تميّزه عن غيره من عيوب القرار الإداري، وكذا استعراض أهم صوره التطبيقية، سواء من خلال الانحراف عن تحقيق المصلحة العامة أو مخالفة قاعدة تخصيص الأهداف. أما الفصل الثاني، فقد خُصص لدراسة إثبات عيب التعسف في استعمال السلطة وآثاره، من خلال تحليل القواعد العامة والخاصة المتعلقة بعبء الإثبات، وبيان مختلف وسائل الإثبات المعتمدة، سواء المباشرة أو غير المباشرة، إضافة إلى إبراز دور القضاء الإداري في الكشف عن هذا العيب. كما تم التطرق إلى الآثار القانونية المترتبة على ثبوته، وعلى رأسها إلغاء القرار الإداري والتعويض عن الأضرار الناتجة عنه. وقد أظهرت الدراسة أن التعسف في استعمال السلطة، رغم صعوبة إثباته لطابعه المعنوي، يشكّل أداة فعالة لحماية مبدأ المشروعية إذا ما فُعّلت الرقابة القضائية بشكل دقيق، غير أن ذلك يظل مرتبطًا بمدى توفر معايير واضحة ووسائل إثبات كافية، الأمر الذي يستدعي تعزيز الإطار القانوني والقضائي بما يضمن تحقيق التوازن بين سلطات الإدارة وحماية حقوق الأفراد. Abstract: Abuse of power is considered one of the most serious defects that may affect administrative decisions, as it undermines the principle of legality and threatens individual rights. It occurs when the administration deviates from the legal purpose for which authority was granted and uses its powers to achieve illegitimate or non-public interest objectives. This dissertation examines and analyzes this defect within the framework of Algerian legislation, highlighting its concept, characteristics, practical forms, methods of proof, and its legal consequences. The first chapter focuses on the theoretical framework of abuse of power by defining it linguistically and legally, presenting both doctrinal and judicial definitions, and identifying its distinguishing characteristics compared to other administrative defects. It also explores its main practical forms, including deviation from public interest and violation of the rule of purpose allocation. The second chapter is devoted to the study of the proof and effects of abuse of power, analyzing the general and specific rules governing the burden of proof, as well as the various means of proof, both direct and indirect. It also highlights the role of administrative courts in detecting this defect. Furthermore, the study examines the legal consequences resulting from its establishment, particularly the annulment of the administrative decision and compensation for damages. The study concludes that, despite the difficulty of proving abuse of power due to its subjective nature, it remains an effective mechanism for protecting legality when judicial oversight is properly exercised. However, this effectiveness depends on the availability of clear legal standards and adequate means of proof, which calls for strengthening the legal and judicial framework to ensure a balance between administrative authority and the protection of individual rights.التعسف في استخدام السلطة وفق التشريع الجزائريOther
