تونسي عمارحمادي يحيتحت إشراف الدكتور : يوسف مرين2025-07-142025-07-142025-07-14http://dspace.cuillizi.dz/handle/123456789/456تهدف هذه المذكرة إلى تسليط الضوء على الوساطة في الجرائم الأسرية كآلية بديلة لحل النزاعات، بالنظر إلى خصوصية العلاقات العائلية وحساسيتها. وقد بيّنت الدراسة أن الوساطة تمثّل خيارًا واعدًا لتحقيق العدالة التصالحية، عبر توفير بيئة ملائمة لتسوية النزاعات دون اللجوء إلى المسار القضائي التقليدي الذي قد يُفاقم من حدة التوتر بين أفراد الأسرة. وتناولت المذكرة الأبعاد النظرية والاجتماعية والتشريعية للوساطة، كما حللت الإطار القانوني المنظم لها في الجزائر، وقارنته ببعض التشريعات العربية والدولية. وركزت أيضًا على آليات تطبيق الوساطة في الواقع العملي، والصعوبات التي تواجهها، مثل غياب مراكز متخصصة، وضعف التكوين، وقصور التوعية المجتمعية. وتوصلت الدراسة إلى مجموعة من النتائج أبرزها ضرورة تقنين الوساطة الأسرية بشكل مستقل، وتعزيز الثقافة التصالحية، وتوفير الإمكانيات البشرية والمادية اللازمة لدعم هذه الآلية. وقد خلصت إلى أن الوساطة الأسرية، إذا ما تم تطويرها بشكل سليم، يمكن أن تكون أداة فعالة لتحقيق استقرار الأسرة، والتقليل من النزاعات، والمساهمة في إصلاح المنظومة العدلية في الجزائر. Abstract: This thesis aims to shed light on mediation in family-related offenses as an alternative mechanism for conflict resolution, considering the sensitive and unique nature of family relationships. The study demonstrated that mediation represents a promising option for achieving restorative justice by providing a suitable environment for resolving disputes without resorting to the traditional judicial process, which may exacerbate family tensions. The thesis explores the theoretical, social, and legal dimensions of mediation, analyzing the legal framework in Algeria and comparing it to selected Arab and international legislations. It also addresses the practical application of mediation, along with the challenges it faces—such as the lack of specialized centers, limited training, and insufficient public awareness. The study concludes with key findings, including the need for specific legal provisions on family mediation, the promotion of a culture of reconciliation, and the mobilization of adequate human and material resources to support this mechanism. Properly developed, family mediation can serve as an effective tool for fostering family stability, reducing disputes, and contributing to the reform of Algeria’s judicial system.Other
