Abstract Theactions ofaperson during their death illness areamong themost sensitiveand complextopics, asthey occur during astage markedby weakenedwillandpotentialpsychologicalandphysicalvulnerability. This maylead to unbalanced decisions that could affect the rights of heirs and creditors. This studyaimedtoanalyze theissueofdispositionsmadebya terminally illpersoninbothAlgerianlawandIslamic jurisprudence, focusing on matters related to personal status such asmarriage and divorce,aswellasfinancialtransactions likecontractsofexchangeand donations. The study adopted a comparative analyticalapproach by examiningrelevant legal texts, comparing them with Islamic jurisprudentialopinions,andanalyzingjudicialpracticesthataddressed such cases. ThefindingsrevealedthatIslamicjurisprudencehasestablishedprecise rulestogoverntheactions ofaterminally illperson,ensuring abalance between individual freedom and the protection of others’ rights. In contrast, Algerian law lacks explicit provisions onthe matter, making judicial discretioncentral. The study recommends developing legislation,enhancing legal and jurisprudential training,andunifyingjudicialstandardstoensurejustice and prevent abuse of such dispositions.Other
