Keywords: Public servant, public utility, insult, infringement, legal protectionملخص: من خلال هذه الدراسة، تم تسليط الضوء على الجرائم التي يكون الموظف العمومي عرضة لها أثناء أو بمناسبة تأديته لمهام بصفته ممثلا للدولة، وذلك بإتباع المنهج الوصفي لتوضيح بعض المفاهيم المتعلقة بهذه الجريمة وكذا المنهج التحليلي لدراسة وتحديد كل الأفعال التي تدخل في إطار الإهانة والتعدي في منظور المشرع الجزائري الذي أضفى حماية قانونية خاصة له، باعتبار أن استمرارية نشاط الدولة وتسيير مرافقها العامة، مرهون بالحفاظ على السلامة الجسدية والمعنوية للموظف العمومي، بحكم أن هذا الأخير هو الرابط المباشر بين الدولة وأفرادها، سواءً من ناحية توفير الخدمات أو من ناحية تنفيذ القوانين والتنظيمات، عليه وجب على المشرع الجزائري تأطير وضبط كل الأفعال غير المشروعة التي تقترف في حق الموظف، مع وضع نصوص قانونية خاصة ومنفردة عن جرائم العنف الأخرى ضمن قانون العقوبات الجزائري، وهذا من أجل محاربة هذه الجرائم وردع مقترفيها بتشديد الجزاءات المقررة لكل فعل يدرج في خانة الإهانة أو التعدي على الموظف العمومي. Through this study, light was shed on the crimes that the public official is exposed to during or on the occasion of performing his duties as a representative of the state, by following the descriptive approach to clarify some concepts related to this crime, as well as the analytical approach to study and identify all acts that fall within the framework of insult and transgression from a perspective The Algerian legislator has given him special legal protection, given that the continuity of the state's activity and the management of its public facilities depends on preserving the physical and moral integrity of the public official,By virtue of the fact that the latter is the direct link between the state and its individuals, whether in terms of providing services or in terms of implementing laws and regulations, the Algerian legislator must frame and control all illegal acts committed against the employee, with special and separate legal provisions for other violent crimes.
