همبزة محمدبن زاير يونسإشراف الدكتور : مفاتيح بومدين2024-12-112024-12-112024http://dspace.cuillizi.dz/handle/123456789/333الكلمات المفتاحية: عقوبة بديلة، العفو الرئاسي، الإفراج المشروط، المراقبة الإلكترونية، التنفيذ Key terms: alternative penalty, presidential pardon, parole, electronic monitoring, execution.ملخص: يهدف هذا البحث الى تحديد مفهوم العفو الرئاسي عن بدائل العقوبات السالبة للحرية في القانون الجزائري التي أثبتت قصورها في تأهيل المحبوسين، لذا اتجه المشرع الجزائري في منظومته العقابية إلى إدراج عقوبات بديلة متعددة ومتنوعة تعمل للقضاء على سلبيات عقوبة الحبس قصير المدة وتحقق أهداف العقوبات المتمثلة في إصلاح الجاني مع مراعاة وجود التوازن والتناسب بين القيم والمصالح المتطورة والمتغيرة داخل المجتمع من جهة وبين الحقوق والحريات الفردية من جهة أخرى، كما تهدف هذه الدراسة عن البحث عن مدى قابليتها للعفو من خلال موقف المشرع، وكذلك رئيس الجمهورية عبر سلطته تنظيمية وإصدار مراسيم وتم تتبع المنهج الوصفي التحليلي بالدرجة الأولى لدراسة هذا البحث. أهم النتائج المتوصل إليها هي أن العقوبات البديلة هي عقوبات جزائية تكرس مفهوم الإصلاح وليست تدابير وقائية وأن المشروع تبنى تدريجيا بدائل غير كافية وأن العفو يمكن أن يشمل الإفراج المشروط و العمل للنفع العام والوضع تحت المراقبة الإلكترونية ليبقى وقف التنفيذ محل جدل فقهيوغموض تشريعي. Summary: This research aims to define the concept of presidential pardon as an alternative to imprisonment in Algerian law, which has proven to be ineffective in rehabilitating prisoners. The Algerian legislator has therefore introduced various alternative penalties to address the shortcomings of short-term imprisonment and achieve the goals of punishment, focusing on balancing evolving societal values and interests on one hand, and individual rights and freedoms on the other. This study also examines the feasibility of pardon through the legislator's stance and the President's regulatory authority. A descriptive analytical and comparative approach is primarily employed in this research.The key findings indicate that alternative sanctions are criminal penalties that embody the concept of rehabilitation rather than preventive measures. The project gradually adopts insufficient alternatives, and amnesty may include parole and alternative fines, in contrast to community service and electronic monitoring, keeping the suspension of execution subject to jurisprudential debate and legislative ambiguity.otherThesis
