عزوز سميربن عبو قدورتحت إشراف الدكتورة : حميدة عماد2025-10-052025-10-052025-10-05http://dspace.cuillizi.dz/handle/123456789/464تمحورت دراستنا هذه حول موضوع حماية المستهلك من مخاطر المنتجات الطبية والتي تعد موضوعا حيويا ومتجددا، نظرا لارتباطها الوثيق بصحة الأفراد،وأيضا التطور العلمي السريع للمنتجات الطبية،ولقد اعتمدنا على المنهج الوصفي والتحليليفي دراستنا هذهللقوانين التي أقرها المشرع الجزائري،حيث سعى هذا الأخير، ضمن قانون الصحة رقم 18-11، في تحديد مفهوم هذه المنتجات وتقييد إنتاجها وبيعها بضوابط صارمة تهدف أساسا إلى حماية مستخدميها،والذي لا يتحقق إلا من خلال فرض التزامات على كل من المنتجين والبائعين، إضافة إلى ذلك سعى المشرع الجزائري، ضمن القانون المدني، وتحديدا في المادة 140 مكررمنه،إلى إقرارالمسؤولية الموضوعية لضمان حق المتضررين من هذه المنتجات،وكذا ليتسنى لهم الحصول على التعويض،ولتعزيز هذه الحماية، تم تشريع القانون 09/03 المتعلق بحماية المستهلك، وأيضا قانون العقوبات بكل تعديلاته وذلك لفرض عقوبات مدنية منها أو جزائية على كل منتج يخل بالتزاماته القانونية المتعلقة بهذه المواد. This study focused on the crucial and evolving topic of consumer protection from the risks of medical products, given its direct link to individual health and the rapid scientific advancements in medical products. We employed a descriptive and analytical methodology to examine the laws enacted by the Algerian legislator. Specifically, Health Law No. 18-11 aimed to define these products and impose strict controls on their production and sale, primarily to safeguard users. This protection is achieved by mandating obligations for both producers and sellers. Furthermore, within the Civil Code, Article 140 bis was introduced to establish strict liability, ensuring the right of those harmed by these products to obtain compensation. To bolster this protection, Law 09/03 concerning consumer protection was legislated, alongside the Penal Code and all its amendments, to impose both civil and penal penalties on any producer who breaches their legal obligations related to these materials penalties on any producer who violates their legal obligations related to these materials.Other
