البراهمي قدوربدياف دريستحت إشراف الدكتور : . مرين يوسف2025-07-032025-07-032025-07-03http://dspace.cuillizi.dz/handle/123456789/443من خلال الانتشار الواسع للمخدرات و المؤثرات العقلية الذي مس جميع أفراد المجتمع بمختلف أطيافه وكذا زعزعة و ضرب الاقتصاد الوطني من خلال الإتــجار بهاته المواد ، و جعلها مهنة الهدف منها الكسب و الربح السريع، جعـــل من المشرع الجزائري ينتهج سياسة عقابية في هذا المجال تتجلى من خلال ما تضمنه القانون المستحدث 23-05 المعدل والمتمم للقانون 04-18 المتعلق بالوقاية من المخدرات و المؤثرات العقلية و قمع الإستعمال و الإتجار غير المشروعين بها أين نجد من خلال دراستنا لهذا القانون أنه جاء لسد جميع المنافذ و الثغرات الموجود في القانون 04-18 ، و يقف سدا منيعا أم مروجي هاته السوم بشتى أنواعها ، حيث راجع التدابير الوقائية و العلاجية مع الفصل بينهما و أعطى صلاحيات للديوان الوطني لمكافحة المخدرات و إدمانها بوضع إستراتيجية وطنية تشارك فيها عدة قطاعات بما في ذلك المجتمع المدني . كما خص فئة الأحداث المستهلكة للمخدرات و المؤثرات العقلية بتدابير علاجية و وقائية إستثنائية بإعتبارهم مرضى ، إستوجب علاجهم و التكفل بهم لا إعتبارهم مجرمين يستوجب عقابهم كما إستحدث نصوص تجريمية تتماشى مع التطور الذي تعرفه جرائم المخدرات ، مع انتهاج أساليب و آليات بحث و تحري جديدة من قبيل أساليب التحري الخاصة لمجابهة هذه الظاهرة الإجرامية . Study Summary: The widespread proliferation of drugs and psychotropic substances, which has affected all members of society across various segments, as well as the destabilization and damage to the national economy through the trafficking of these substances, making it a profession aimed at quick gain and profit, has led the Algerian legislator to adopt a punitive policy in this field. This is evident through the provisions of the newly enacted Law 23-05, which amends and supplements Law 04-18 concerning the prevention of drugs and psychotropic substances and the suppression of their illicit use and trafficking. Through our study of this law, we find that it aims to close all loopholes and gaps present in Law 04-18, and stands as an impenetrable barrier against the promoters of these poisons of all kinds. It has revised preventive and therapeutic measures, separating them, and granted powers to the National Office for Combating Drugs and Addiction to develop a national strategy involving several sectors, including civil society. It also specifically addressed the category of minors who consume drugs and psychotropic substances with exceptional therapeutic and preventive measures, considering them patients who require treatment and care, rather than criminals who deserve punishment. Furthermore, it introduced criminalization provisions that align with the evolution of drug crimes, along with the adoption of new investigative methods and mechanisms, such as special investigative techniques, to confront this criminal phenomenon.Other
