Keyword : legal liability for environmental pollution criminal liability, Civil liability.ملخص: ان الهدف من هذه الدراسة يتمحور حول المسؤولية القانونية عن التلوث البيئي وهذا عن طريق الإحاطة بالمسؤولية الجزائية سواء كانت مسؤولية الشخص الطبيعي عن فعله الشخصي، أو عن فعل الغير وكذا المسؤولية المترتبة عن الشخص المعنوي، كما تم التطرق للمتابعة الجزائية وموانع المسؤولية المترتبة عن الضرر البيئي. والمسؤولية المدنية الناتجة عن التلوث والضرر البيئي من خلال تحديد النظام القانوني، والجزاء المترتب عن قيام المسؤولية المدنية عن التلوث البيئي. وقد أوضحت نتائج الدراسة الأهمية التي أولها المشرع الجزائري لحماية البيئة، من جريمة التلوث التي تعتبر من أخطر الجرائم الماسة بالبيئة. ومن أهم التوصيات تفعيل الجانب الوقائي والردعي، وكذا التكثيف من الحملات التحسيسية حول أهمية المحافظة على البيئة. Abstract : The aim of this study is to focus on legal liability for environmental pollution, This is by invoking criminal liability, Whether it is the natural person's responsibility for his own act or for the act of a third party as well as liability of the legal person ,Penal follow-up and liability impediments for environmental damage were also addressed. Civil liability resulting from pollution and environmental damage by defining the legal system, and the penalty for civil liability for environmental pollution. The results of the study illustrated the importance attached by Algerian legislation to the protection of the environment, of pollution, one of the most serious crimes against the environment. Among the most important recommendations is the activation of the preventive and deterrent aspect, as well as the intensification of sensitization campaigns on the importance of environmental conservation.otherThesis
