قلالــــي عبدالعزيزأوميدي مصطفيتحت إشراف الدكتور : عريشة فاروق2025-07-072025-07-072025-07-07http://dspace.cuillizi.dz/handle/123456789/447تشير الدراسات إلى أن مسار الاستثمار في قطاع الطاقات المتجددة في الجزائر يواجه عقبات متعددة الأوجه، تتراوح بين التحديات القانونية التي تتطلب تبسيطًا وتحديثًا، والمعوقات الاقتصادية التي تستدعي توفير حوافز مالية مستدامة، وصولًا إلى التحديات التقنية التي تستلزم الاستثمار في البحث والتطوير والبنية التحتية المتطورة. وعلى الرغم من المساعي التشريعية التي بُذلت لتعزيز هذا القطاع الواعد، إلا أن الإطار القانوني الحالي لا يزال بحاجة إلى مزيد من الوضوح والقدرة على التكيف مع التطورات العالمية المتسارعة في مجال تكنولوجيا الطاقات المتجددة وتنظيم استثماراتها. وقد توصلت نتائج هذه الدراسة إلى التأكيد على ضرورة إحداث تحول جوهري في الأطر القانونية الحالية، وذلك من خلال تبني تشريعات تتميز بالمرونة والقدرة على استيعاب الابتكارات المتلاحقة في هذا القطاع. كما تبرز الحاجة الملحة إلى دعم تطوير بنية تحتية قوية ومتكاملة قادرة على استيعاب مشاريع الطاقة المتجددة ونقلها وتوزيعها بكفاءة. بالإضافة إلى ذلك، فإن تعزيز مبادئ الشفافية في الإجراءات ومنح حوافز مالية واستثمارية جاذبة وطويلة الأمد، يعتبران من الركائز الأساسية لتحفيز المستثمرين المحليين والأجانب على الانخراط بقوة في هذا المجال. إن تحقيق أهداف التنمية المستدامة في الجزائر والاستفادة القصوى من الإمكانات الهائلة التي تتيحها الطاقة المتجددة، يتطلب ضرورة ملحة لمواءمة الإطار القانوني الوطني مع أحدث التوجهات والمعايير العالمية في هذا القطاع. ولا يمكن تحقيق هذه الغاية إلا من خلال تعزيز التعاون والتنسيق الفعال بين جميع الأطراف المعنية، بما في ذلك الحكومة والقطاع الخاص والمؤسسات البحثية والمجتمع المدني. إن تضافر هذه الجهود سيمهد الطريق نحو تحقيق الأهداف الطاقوية للجزائر بشكل مستدام، وبما يخدم المصالح العليا للاقتصاد الوطني ويضمن حماية البيئة للأجيال الحالية والمستقبلية. Studies indicate that the investment landscape in Algeria's renewable energy sector faces multifaceted obstacles, ranging from legal challenges requiring simplification and modernization, and economic constraints necessitating the provision of sustainable financial incentives, to technical hurdles demanding investment in research and development and advanced infrastructure. Despite legislative efforts aimed at bolstering this promising sector, the current legal framework still requires greater clarity and adaptability to keep pace with the rapid global advancements in renewable energy technology and investment regulation. The findings of this study underscore the necessity for a fundamental transformation of the existing legal frameworks, through the adoption of legislation characterized by flexibility and the capacity to absorb the continuous innovations within this sector. Furthermore, there is a pressing need to support the development of a robust and integrated infrastructure capable of accommodating the generation, transmission, and efficient distribution of renewable energy projects. Additionally, reinforcing the principles of transparency in procedures and granting attractive, long-term financial and investment incentives are considered fundamental pillars for motivating both domestic and foreign investors to engage actively in this field. Achieving sustainable development goals in Algeria and maximizing the immense potential offered by renewable energy urgently requires aligning the national legal framework with the latest global trends and standards in this sector. This objective can only be realized through the enhancement of effective cooperation and coordination among all relevant stakeholders, including the government, the private sector, research institutions, and civil society. The synergy of these efforts will pave the way for the sustainable achievement of Algeria's energy objectives, serving the higher interests of the national economy and ensuring environmental protection for present and future generations.Thesis
