Key words: Experience, forensic medical expertise, criminal evidence.ملخص يحتل موضوع الخبرة الطبية الشرعية مكانة هامة في مجال الإثبات الجنائي، خصوصا مع تطور الأساليب الإجرامية فهي وضعت بين أيدي محترفي الإجرام الوسائل الحديثة لتسهيل ارتكابهم جريمتهم وإخفاء معالمها عن عيون التحقيق. ومسايرة لهذا التطور كان لا بد من إرساء سياسة جنائية مستندة على التقنيات العلمية الحديثة، فكانت للخبرة الطبية الشرعية الأهمية الكبرى في مجال التحقيق الجنائي حيث سهلت العملية بالنسبة للقضاة لإثبات الجريمة، وإعطاء التكييف القانوني لها انطلاقا من نتائجها القطعية و العلمية . وعلى الرغم من هذه الأهمية فان ذلك لم يشفع لها بان تعامل معاملة تفضيلية مقارنة مع غيرها من طرق الإثبات الكلاسيكية، فهي تخضع لمبدأ الاقتناع الشخصي للقاضي الجنائي حتى ولو تمت بإجراءات شرعية وفي إطار مشروع، و تدعمت بضمانات احترام حقوق الدفاع. لذلك فأوجب على التشريع القانوني إحاطتها بضمانات اكبر حتى تكفل لها مكانة تتصدر بها أدلة الإثبات الأخرى نظرا لدقتها وقطعيتها و موضوعيتها. Abstract : The subject of forensic medical expertise occupies an important place in the field of criminal proof, especially as criminal methods have evolved. It has put in the hands of criminal professionals modern means to facilitate their commission of their crime and conceal its features from the eyes of the investigation. In keeping with this development, it was necessary to establish a criminal policy based on modern scientific techniques. Forensic medical expertise was of great importance in the field of criminal investigation. It facilitated the process for judges to prove the crime and give legal adaptation to it based on its definitive and scientific results. Despite this importance, this has not been accompanied by preferential treatment as compared to other classic methods of proofs, which are subject to the criminal judge's personal conviction, even though legitimate and legitimate proceedings, and are supported by guarantees of respect for the rights of the defence. Therefore, legal legislation had to give it greater safeguards in order to ensure that it had a place at the forefront of other evidence, given its accuracy, severity and objectivity.otherThesis
