جيلالي سيف الاسلامقاسو ابراهيمإشراف الدكتورة : حملاوي نجاة2024-12-022024-12-022024http://dspace.cuillizi.dz/handle/123456789/95الملخص عرف العالم منذ زمن تنافس شديد في مجال الممارسات التجارية، ما أدى ببعض الدول إلى الاحتفاظ بالمعلومات السرية التي من شأنها أن تعطيها ميزة تنافسية، لكن البعض منها شهدت اعتداءات ومنافسة غير مشروعة ما دفع باتفاقية تريبس إلى دعوة الأعضاء فيها إلى حماية حقوق الملكية الفكرية خاصة فيما يتعلق بالأسرار التجارية والتنبيه لأهميتها، وبناء قانون خاص يتعلق بها، فسعت هذه الدول إلى تطوير منظومتها القانونية من خلال توفير الأمن والحماية لهذا النوع من المعلومات السرية فانتقلت طرق الحماية من دولة لأخرى، غير أنها لا تخالف أحكام الاتفاقية، ونصت على أحكام مدنية وجزائية في حين أن المشرع الجزائري لم يوفق لحد الساعة في توفير الحماية، للأسرار التجارية وتقنين نصوص وأحكام جزائية تتعلق بها وأكتفي بما يسمى بالأسرار المهنية خاصة ما يتعلق بالتقنيات التكنولوجية منها، إلا أنه هناك تشابه بين المصطلحات الواردة في قانون الممارسات التجارية ويبقى تطبيق أحكامها لا يتناسب مع قيمة السر التجاري. The world has long been aware of intense competition in the field of business practices, leading some countries to safeguard secret information that could give them a competitive edge. However, some have experienced attacks and unfair competition, prompting the TRIPS agreement to call on its members to protect intellectual property rights, especially concerning trade secrets, highlighting their importance. Consequently, specific laws were enacted to address this issue. These countries have sought to enhance their legal framework by ensuring security and protection for such confidential information, with protection methods varying from one country to another while remaining compliant with the agreement. They have stipulated civil and criminal provisions, whereas the Algerian legislator has yet to provide adequate protection for trade secrets, regulate related texts and provisions, only addressing what is known as professional secrets, particularly in technological aspects.
