Keywords : acquisitive restriction, private real estate, possession, cadastral survey, real estate investigationملخص: من خلال بحثنا هذا حاولنا جاهدين التطرق، إلى موضوع يمكن القول عنه أنه موضوع الحالي، والذي يستقطب اهتمام طلبة الحقوق، وكذا اقتصاد الدولة على حد سواء نظرا لأهميته البالغة على المستوى الوطني بل إنه يحظى بالاهتمام على المستوى الدولي. لقد أعطى المشرع الجزائري أهمية بالغة لموضوع إكتساب الملكية العقارية عن طريق التقادم المكسب، كما بين المشرع طرق الحيازة من خلال القوانين و النصوص التشريعية. الأهمية تظهر في كون أن المشرع الجزائري يسعى جاهدا للبحث عن الحلول والسبل التي يواجها من خلال العراقيل التي تنجم عن إكتساب الملكية العقارية عن طريق التقادم المكسب. ونظرا لأهمية الموضوع، فإنه بات من الضروري تبني رزنامة تشريعية تتميز بسهولة الإجراءات حتى تكون في متناول الجميع، كي لا ندع أي مجال للصدفة أو للاحتكام للعقود العرفية التي أرهقت وعطلت مصالح الجميع. كما يجب البحث في آلية جديدة من شأنها التعريف بالمستجدات الحاصلة في مجال العقار والتشريعات المنظمة له على المستوى الوطني، من خلال استغلال قنوات الاتصال القريبة من المواطن بشكل عام و إلى المهتمين بالعقار بشكل خاص. ABSTRACT : Through our research, we have tried very hard to address a topic that can be said that it’s the topic of the day, which attracts the attention of law students, as well as the economy of th country, both because of its great importance at the national level and even receives attention at the international level. Algerian legislator has given great importance to the topic of the acquisition of real property by means of gainful statute of limitations, as well as to the methods of acquisition through laws and legislative texts. The importance is shown by the fact that Algerian legislator strives to seek solutions and ways to be confronted by obstacles, resulting from the acquisition of real estate property through gainful statutory limitations. Given the importance of the topic, it has become necessary to adopt a legislative calendar that is easy to act in order to be accessible to all, so as not to leave any room for chance or to invoke customary contracts that have overstretched and disrupted everyone's interests. A new mechanism should be explored to familiarize itself with developments in the field of real estate and the legislation regulating it at the national level, by exploiting channels of communication close to the citizen in general and to those interested in the property in particular.otherThesis
