| dc.description.abstract | ملخص إن المشرع الجزائري يسعى إلى سن قوانين إجرائية من أجل محاكمة عادلة تضمن موازنة بين حق المجتمع من توقيع العقاب وحقوق وحريات المتهم كان لا بد من البحث والكشف عن الحقيقة حتى يكون الحكم الفاصل في نزاع الدعوى العمومية سليما، لذا لا بد لمن أنيطت به مهمة الفصل في هذا النزاع أن يتمتع بسلطات وصلاحيات يخول له من خلالها الوصول إلى الحقيقة القضائية، وهذا بعد عملية تكييف الوقائع في نطاق حدود الدعوى وتقدير الأدلة من أجل توقيع أنسب العقوبات التي من شأنها إصلاح الجاني، وهذا في إطار ضوابط وشروط ترشد قاضي الحكم وتكون له معيارا على مدى سلامة اقتناعه الشخصي الذي يصل به إلى براءة أو إدانة المتهم. Abstract The Algerian legislatorseeks to enactprocedurallaws for a fair trial thatguaranteesabalancebetween the right of society to impose punishment and the rights and freedoms of the accused. The truth must beresearched and revealed in order for the final ruling in the public lawsuit dispute to besound. Therefore, itisnecessary for thoseentrustedwith the task of adjudicating the matter to This dispute isthathe has powers and powersthatallowhim to reach the judicialtruth This isafter the process of adapting the factswithin the limits of the case and evaluating the evidence in order to impose the mostappropriate penalties thatwouldreform the offender, and thisiswithin the framework of controls and conditions that guide the sentencingjudge and serve as a criterion for him on the soundness of hispersonal conviction that leads to the acquittal or conviction of the accused. | |
