| dc.description.abstract | ملخص: سعت الجزائر منذ الاستقلال الى النهوض باقتصادها واكتساب التطور الذي سيجعلها تتمتع بتنمية اقتصادية دائمة ولان الاستثمار أحد اهم مكونات الاقتصاد الناجح كان له النصيب الأكبر من اهتمام الدولة الجزائرية ولذلك كانت في كل مرة تسن قوانين تنظم هذا المجال حتى أصبح لديها ترسانة معتبرة من القوانين المتعلقة بالاستثمار. وباعتبار المستثمر أحد اركان الاستثمار كان لابد على المشرع الجزائري الاهتمام بمشاغله والسعي لضمان حقوقه لان كسب المستثمر اول خطوة لجذب الاستثمار للدولة لذا كان من الضروري الإحاطة بموضوع حماية حقوق المستثمر بطريقة تحليلية لمعرفة ما اذا كان ما انتهجته الدولة الجزائرية كفيل بالوفاء بمتطلبات المستثمر وكفيل بحماية حقوقه على أكمل وجه وهذا ما جعلنا نكتشف في نهاية الامر أن اجتهاد المشرع الجزائري في كل مرة لوضع قوانين وتشريعات تفي بمتطلبات المستثمر يجعله جدير بالثقة من طرف هذا الأخير ولو أن كل تلك القوانين لم تبلغ حقيقة ما يجعل الاستثمار في الجزائر خالي من التعقيدات والمخاطر ولا زال الأوان مبكرا على وصف الاستثمار في الجزائر بالمجال المضمون وعلى الدولة قطع بعض الأشواط الإضافية لبلوغ الأهداف الاستثمارية المرجوة وهذا من خلال سياستها المنتهجة حديثا و التي تبدو واعدة في هذا المجال . Abstract: Since independence, Algeria has sought to advance its economy and achieve developmentthat will enable it to enjoy permanent economic development Because investment is one of the most important components of a successful economy, it has had the largest share of the Algerian state’s attention, and therefore every time it has enacted laws regulating this field until it has a large arsenal of laws related to investment. Considering the investor as one of the pillars of investment, the Algerian legislator had to pay attention to his concerns and strive to guarantee his rights, because winning over the investor is the first step to attracting investment to the country.Therefore, it was necessary to analyze the issue of protecting investor rights in order to determine whether what the Algerian state has adopted is sufficient to meet the investor’s requirements and protect his rights at all.To the utmost extent, this is what made us discover in the end that the Algerian legislator’s keenness every time to establish laws and legislation that meet the investor’s requirements makes him trustworthy, even if all of these laws do that and we have not arrived at the truth of what makes investment in Algeria free of complications and risks.And it's still early.He described investment in Algeria as a guaranteed field, and the state must go the extra mile to achieve the desired investment goals, through its recently adopted policy, which appears promising in this field. | |
