| dc.description.abstract | ملخص بالعربية لقد خص المشرع الجزائري محاكمة الأحداث الجانحين بنصوص وقوانين وإجراءات وأضفى عليها خصوصية تختلف عن تلك المتبعة ضد البالغين من اجل توفير الحماية القانونية لهم اثناء مرحلة المحاكمة التي تشكل امرا حاسما في مصير الطفل لما تسفر عنه من حكم جزائي يقضي ببراءته أو إدانته وتتجلى هذه الخصوصية بدءا من الجهات القضائية المنوط لها محاكمتهم مرورا بإجراءات سير المحاكمة وصولا الى طبيعة الأحكام والتدابير الصادرة في مواجهتهم والتي يغلب عليها الطابع التربوي و الاصلاحي على الطابع العقابي فهي تقوم على أساس تربية الحدث واصلاحه وإبراز دور قاضي الاحداث في إعادة تأهيله وإدماجه في المجتمع. ملخص بالإنجليزية The Algerian legislator singled out the trial of juvenile delinquents with texts, laws, and procedures, and gave it a specificity that differs from that used against adults in order to provide legal protection for them during the trial stage, which is decisive in the fate of the child, as it results in a criminal ruling that acquits him or condemns him. This privacy is evident starting from The judicial authorities entrusted with their trial, going through the procedures for the conduct of the trial, leading to the nature of the rulings and measures issued against them, which are predominantly educational and reformist in nature over punitive ones. | |
