| dc.description.abstract | تُعد هذه المذكرة د ارسة قانونية معمقة حول "التنظيم الإداري والتسيير المالي للمؤسسات الصحية في الجزائر ".تهدف الدراسة إلى تحليل الإطار المفاهيمي والقانوني لهذه المؤسسات بوصفها مرافق عامة تهدف لتقديم خدمات الوقاية والعلاج . تتمحور إشكالية البحث حول مدى نجاعة الإطار القانوني الحالي في ضمان فعالية الأداء الصحي . وقد توصلت الد ارسة إلى أن المشّرع الج ازئري اعتمد هيكلة متنوعة تشمل المؤسسات العمومية الاستشفائية ) (EPHوالمؤسسات الجوارية) ، (EPSPإضافة إلى فتح المجال للاستثمار الخاص . من الناحية الإدارية، تخضع هذه المؤسسات لنموذج تسيير يجمع بين السلطة التقريرية لمجلس الإدارة والدور التنفيذي للمدير، مع وجود هيئات استشارية كالمجلس الطبي .مالًيا، تلتزم هذه المؤسسات بقواعد المحاسبة العمومية وتخضع لرقابة مالية دقيقة (قبلية وبعدية) لضمان الشفافية وحماية المال العام . تخلص المذكرة إلى أن تطوير المنظومة الصحية يتطلب إصلاحات توازن بين زيادة الطلب وجودة الخدمة، مع تحديث أساليب التسيير لمواكبة التحديات التكنولوجية والاجتماعية الراهنة . This thesis constitutes an in-depth legal study on the "Administrative Organization and Financial Management of Health Institutions in Algeria." The study aims to analyze the conceptual and legal framework of these institutions as public utilities dedicated to providing preventive and curative services.58 The research problem focuses on the effectiveness of the current legal framework in ensuring efficient healthcare performance. The study finds that the Algerian legislator has adopted a diversified structure encompassing Public Hospital Establishments (EPH) and Public Primary Healthcare Establishments (EPSP), in addition to opening the sector to private investment. Administratively, these institutions are subject to a management model that combines the decision-making authority of the Board of Directors with the executive role of the Director, supported by advisory bodies such as the Medical Council. Financially, these institutions adhere to public accounting rules and are subject to rigorous financial oversight (both ex-ante and ex-post) to ensure transparency and the protection of public funds. The thesis concludes that developing the healthcare system requires reforms that balance increasing demand with service quality, alongside modernizing management methods to keep pace with current technological and social challenges. | |
