Abstract
ملخص :
لا شك أن التطور التكنولوجي طغى ومس جميع المجالات بما فيها القانون من خلال ظهور نظام قضائي جديد قائم على أسس وقواعد وتشريعات وأحكام قضائية في ظل عصر المعلوماتية والتقنية الرقمية ،فقد كان ظهوره نتيجة بطئ العدالة التقليدية وعبئ تكاليفها المالية الذي أثقل كاهل المتقاضيين .
فقد أقر المشرع الجزائري بآلية التقاضي الإلكتروني كأحد آليات العصرنة التي أتى بها القانون 15-03 ، المتعلق بعصرنة العدالة ، وتعديل قانون الإجراءات الجزائية بموجب الأمر 20-04 ، بعنوان المحاكمة المرئية عن بعد ، وذلك من أجل تبسيط إجراءات التقاضي على المواطنين ، وزادت أهمية العمل به في ظل جائحة كورونا ، ومن ثمة نهدف من خلال هذه الدراسة إلى معرفة ماهية التقاضي الإلكتروني وتعريف بمختلف أنواع الوسائل التكنولوجية المستخدمة في إجراءاته ،و إبراز أهم التحديات والصعوبات التي تعترض تطبيقه.
Abstract:
There is no doubt that technological has overwhelmed and affected all journals including law through the emergence of a new judicial system based on foundations rules legislation and judicial rulings in light of the age of information and digital technology its emergence was the result of the slowness of traditional justice and the burdened the litigants.
The Algerian legislator approved electronic litigation as one of the mechanisms of modernity which was introduced by law No15-03 relating to the modernization of justice and amending the code of criminal Procedure in accordance with Order 20-04 entitled Remote video trial this is in order to simplify litigation procedures for citizens the importance of working on it has increased in light of the corona pandemic.
Therefore we aim through this study to know what electronic litigation is to introduce the various types of technological means used in its procedures and to highlight the most important challenges and difficulties that obstruct its application.
