dc.description.abstractالملخص : من خلال هذه الدراسة المتعلقة بالأساليب العلمية الحديثة , ومشروعية الأدلة المستمدة منها , فإنها طرق الفنية التقنية حديثة متطورة , تساهم في الإثبات الجريمة والكشف عن مرتكبيها , والتي بدورها تكون عن طريق إجراء الخبرة للوصول إلى ذلك , حيث منها ما يمكن أن يؤثر على حياة الأشخاص الخاصة , وحريتهم الأساسية مثلا كالبصمة الوراثية , والأساليب الخاصة بتحري. وأن مجمل هذه الأدلة ماهي إلا أداة تزود العدالة بالأدلة , لبناء أحكامها على أساسها ,إلا أنها تتقيد من طرف القاضي الجزائي الذي له السلطة وحرية في تقدير ما تم إسفار عنها من الدلائل للإثبات الجنائي,والقاضي الجزائي بدوره هو أيضا يتقيد أو يخضع لقيود أثناء ممارسة حريته وسلطته التقديرية في إصدار الأحكام الجزائية أو القضائية ,سواء تلك التي ترد عليه أو تلك التي ترد على الأدلة الجنائية. الكلماتالمفتاحية : Through this survey related to modern scientific methods and the legitimacy of evidence derived from them, these modern advanced technical strategies contribute to proving crimes and identifying their perpetrators. This is achieved throughconducting expertise to reachthat goal, as some of themmay impact individuals' lives and fundamental freedoms, such as genetic fingerprinting and specific investigation methods. Overall, these pieces of evidence are nothing but tools that provide justice withe vidence to base its judgments on. However, they are subject to the discretion of the criminal judge, who has the authority and freedom to assess the evidence presented for criminal proof.
