Keywords: Administrative liability; service-related fault; liability without fault; administrative compensation; administrative judiciary.تعالج هذه المذكرة موضوع النظام القانوني للمسؤولية الإدارية وتطبيقاتها، باعتباره من أهم موضوعات القانون الإداري المرتبطة بحماية حقوق الأفراد في مواجهة نشاط الإدارة. وتهدف الدراسة إلى بيان مفهوم المسؤولية الإدارية وتطورها التاريخي وتمييزها عن المسؤولية المدنية والجنائية، مع تحديد الأسس التي تقوم عليها، سواء على أساس الخطأ أو بدون خطأ. كما تتناول الدراسة أهم تطبيقات المسؤولية الإدارية في ضوء الاجتهاد القضائي، خاصة المسؤولية عن الأعمال المادية، والأشياء والأشغال العامة، وأعمال الضبط الإداري. وتركز كذلك على التعويض عن ضرر الإدارة من حيث طبيعته وضوابط تقديره وإجراءات دعواه أمام القضاء الإداري. وقد خلصت الدراسة إلى أن المسؤولية الإدارية تمثل ضمانة فعالة لتحقيق التوازن بين امتيازات الإدارة وحماية حقوق الأفراد. Abstract : This dissertation addresses the topic of the legal system of administrative liability and its applications, as one of the most important subjects of administrative law related to the protection of individuals’ rights against administrative activity. The study aims to clarify the concept of administrative liability, its historical development, and its distinction from civil and criminal liability, while identifying the legal foundations upon which it is based, whether fault-based or without fault. The study also examines the main applications of administrative liability in light of judicial jurisprudence, particularly liability arising from material acts, public works and objects, and administrative police activities. Furthermore, it focuses on compensation for administrative damage in terms of its nature, the standards governing its assessment, and the procedures for filing claims before administrative courts. The study concludes that administrative liability constitutes an effective guarantee for achieving a balance between the privileges of the administration and the protection of individuals’ rights.Other
