    الحماية الجنائية لحقوق الإنسان

    مستخلص البحث: تعد مسألة الحماية الجنائية لحقوق الإنسان، من المواضيع المهمة في عصرنا الحالي وهذه الاهمية جاءت نتيجة لما تتعرض له هذه الحقوق، من إنتهاكاتجسيمة، إضافة إلى عدم وجود رادع قوي للحد من هاته الإنتهاكات، فكان من الضروري توفير حماية جنائية لها على الصعيدين الوطني والدولي، وذلك من خلال النصوص القانونية المنصوص عليها في الإعلانات والموائيقوالإتفاقيات الدولية وعلى وجه الخصوص النظام الأساسي للمحكمة الجنائية الدولية. وتكمن مشكلة الدراسة في أن حقوق الانسان تتعرض للإنتهاك على نحو كبير و واسع ،وعلى الرغم من إنشاء محكمة جنائية دولية مختصة لمعاقبة مرتكبي تلك الجرائم ، فمازال هناك إنتهاكات مستمرة لهذه الحقوق . وإنتهت هذه الدراسة بمجموعة من النتائج والإقتراحات (التوصيات)اللآزمة، منها ما يطور الحماية الجنائية الدولية، ومنها مايخص إدراج حقوق الإنسان المحمية دوليا، ضمن النظام الأساسي للمحكمة الجنائية. Abstract: The issue of criminal protection of human rights is one of the important topics in our current era, and this importance came as a result of the serious violations that these rights are exposed to, in addition to the lack of a strong deterrent to limit these violations, so it was necessary to provide criminal protection for them at the national and international levels. This is through the legal texts stipulated in international declarations, conventions and agreements, in particular the Statute of the International Criminal Court. The problem of the study is that human rights are being violated in a large and widespread manner, and despite the establishment of a specialized international criminal court to punish the perpetrators of these crimes, there are still ongoing violations of these rights. This study concluded with a set of important results and necessary suggestions (recommendations), including those that develop international criminal protection, and those that include including internationally protected human rights within the statute of the Criminal Court.
