    تتناول هذه الدراسة قضية المياه الجوفية العابرة للحدود الوطنية كواحدة من أهم التحديات التي تواجه المجتمع الدولي في القرن الحادي والعشرين. فمع تزايد ندرة المياه العذبة واشتداد حدة التغيرات المناخية، أصبحت هذه الموارد المشتركة بين الدول عنصراً حاسماً في الأمن المائي والاستقرار الإقليمي. تبرز أهمية الموضوع من خلال الدور الحيوي الذي تلعبه المياه الجوفية في تلبية الاحتياجات الأساسية للسكان، حيث تشكل المصدر الرئيسي للمياه في العديد من المناطق الجافة وشبه الجافة. ومع ذلك، فإن طبيعة هذه الموارد "الخفية" وتجاوزها للحدود الوطنية السياسية يجعل إدارتها أمراً بالغ التعقيد، خاصة في ظل غياب أطر قانونية دولية شاملة تنظم استخدامها. This study addresses the issue of transboundary groundwater as one of the most significant challenges facing the international community in the 21st century. With the increasing scarcity of freshwater and the intensification of climate change, these shared resources have become a critical element in water security and regional stability. The importance of the topic lies in the vital role groundwater plays in meeting the basic needs of populations, as it constitutes the primary source of water in many arid and semi-arid regions. However, the "invisible" nature of these resources and their crossing of political boundaries make their management extremely complex, especially in the absence of comprehensive international legal frameworks to regulate their use.
