    جريمة اختطاف الأطفال في التشريع الجزائري

    ملخص المذكرة: إن تفشي جرائم اختطاف الأطفال في العالم عامة وفي المجتمع الجزائري خاصة، جعلت الجميع يبحث عن السبل والوسائل للحد من انتشارها، هذه الجريمة التي تطلبت منا الوصف والتحليل، في دراستها في التشريع الجزائري، لها نتائج وعواقب وخيمة على حياة الأفراد وبخاصة الطفل، فهي تستهدف حريته وأمنه واستقراره وكرامته، وتضرب بشكل مباشر عمق المجتمع والدولة، في قدرتها على حماية ساكنيها. وحــاول المشرع الجزائـري من خــلال سن النصـوص القانونية والتعديلات المتكررة لموادها، التصدي لهذه الجريمة الخطيرة والمركبة التي ترتبط بجرائم أخري لا تقل خطورة عنها، والتي هي غالبا الغاية من الاختطاف، كالاغتصاب، وذلك لردع الجناة بأن ينالوا عـــقــابهم عــند ارتـــكابــــهم هــــذه الجــــريمة، وتــرهيب كل من يفكر في ارتكابها، بتجنيد مختلف مؤسسات الدولة واجهزتها والمجتمع المدني، باعتماد آليات للوقاية منها، ومكافحـتها عن طريق ملاحقة مرتكبوها وتشديد العقوبات عليهم، التي تصل إلى الإعدام. وخلاصة الدراسة، الجميع معني بالمساهمة في الحد من انتشار هذه الجريمة. ABSTRACT The spread of the phenomenon of child abduction in the world in general and in Algerian society, made everyone search for ways and means to limit its spread. This crime, which required us to describe and analyze it, in its study in Algerian legislation, has dire consequences for the lives of individuals, especially the child, as it targets his freedom and security, stability and dignity, and directly strike the depth of society and the state, in its ability to protect its inhabitants. The Algerian legislator, through the enactment of legal texts and repeated amendments to its articles, has tried to address this serious and complex crime, that is linked to other crimes that are no less serious than it, Kidnapping is often a way to achieve them, such as rape, by deterring the perpetrators from being punished, when they commit this crime, and intimidating anyone who thinks In committing it, by recruiting the various state institutions and agencies and civil society, by adopting mechanisms to prevent and combat it, by prosecuting the perpetrators and tightening the penalties for them, which reach the death penalty. In conclusion, everyone is concerned with contributing to limiting the spread of this crime.
