| dc.description.abstract | ملخص الدراسة: إن الضوابط القانونية التي وضعها المشرع لترشيد تصرفات القاصر سواء كان مميزا أو غير مميز تساهم في حماية مصالحه وضمان تصرفاته القانونية بشكل يتناسب مع مصلحته الفضلى، فالقاصر يعتبر بحسب القانون شخصًا لم يبلغ بعد سن الرشد القانوني ولا يمتلك الأهلية الكاملة لإجراء التصرفات القانونية أو المالية لذا تطلب الأمر وجود آليات تضبط تصرفاته ولا تضر بمصالحه سواء كانت مادية أو معنوية ، حيث يُعطى لقاضي شؤون الأسرة دورًا حمائيًا يخوله صلاحية ترشيد القاصر للتصرف في شؤونه مع الحفاظ على رقابته قضائيا ليضمن عدم إضرار هذه التصرفات بمصالح القاصر، فالضوابط القانونية مهمة لكونها توفر الحماية للقاصر من التصرفات التي قد تكون مضرة أو غير مدروسة، فهي تعزز مبدأ المصلحة الفضلى له كأساس لأي تصرف قانوني يخصه، لذا فإن هاته الضوابط تعد جزءًا أساسيًا من النظام القانوني الذي يسعى لتوفير بيئة آمنة ومحمية للقاصرين، مما يسمح لهم بالنمو والتطور في بيئة مستقرة ومحمية قانونيًا. Abstract: The legal regulations established by the legislator to regulate the actions of minors, whether distinguished or undistinguished, contribute to protecting their interests and ensuring their legal actions are in line with their best interests. Minors are considered, according to the law, individuals who have not yet reached the legal age of majority and do not have full legal capacity to perform legal or financial actions. Therefore, it is necessary to have mechanisms that regulate their actions without harming their interests, whether material or moral. Family court judges are given a protective role that grants them the authority to guide minors in their affairs while maintaining judicial oversight to ensure that these actions do not harm the minor's interests. Legal regulations are important as they provide protection for minors from actions that may be harmful or unwise, thereby reinforcing the principle of their best interests as the basis for any legal action concerning them. Therefore, these regulations are an essential part of the legal system, which seeks to provide a safe and protected environment for minors, allowing them to grow and develop in a stable and legally protected environment. | |
