dc.description.abstractتتمحور الدراسة حول "الحماية الجزائية لحقوق ذات الإعاقة في التشريع الجزائري"، حيث تعالج إشكالية مدى كفاية المنظومة القانونية الوطنية في توفير حماية وردع فعالين ضد الاعتداءات التي تتعرض لها هذه الفئة الهشة. استُهلت الدراسة بضبط الإطار المفاهيمي للإعاقة وتصنيفاتها (حركية، حسية، وعقلية ومتعددو الإعاقة) وأسبابها، مع استعراض تطور نظرة المشرع من الرعاية الاجتماعية إلى تكريس "المواطنة الكاملة" تماشياً مع الاتفاقيات الدولية. وينصب جوهر المذكرة على تحليل آليات الحماية؛ بدءاً بالامتيازات القانونية كالحق في التعليم والعمل والصحة والولوج للمنشآت، وصولاً إلى الحماية الجزائية المشددة التي أقرها قانون العقوبات والقوانين الخاصة (مثل قانون مكافحة الاختطاف)، حيث اعتبر المشرع "حالة الإعاقة" ظرفاً مشدداً يستوجب أقصى العقوبات عند وقوع جرائم مثل الخطف، الاستغلال في التسول، التحرش، أو الاعتداء الجسدي، وذلك لتعويض النقص في قدرة الضحية على الدفاع عن نفسها. وتخلص الدراسة إلى أن المشرع الجزائري قد أرسى ترسانة قانونية متينة، لكنها تستوجب تفعيلاً أدق للآليات الرقابية وتوحيد النصوص المشتتة لضمان أقصى درجات الفاعلية والاندماج الاجتماعي الحقيقي. الكلمات المفتاحية : - ذات الإعاقة - حقوق الأشخاص ذوي الإعاقة - الجرائم الواقعة على ذوي الإعاقة - التمييز ضد ذوي الإعاقة - الفئات الهشة -العنف ضد ذات الإعاقة - الرعاية القانونية لذوي الاحتياجات الخاصة Abstract: The study focuses on "The Penal Protection of the Rights of Persons with Disabilities in Algerian Legislation." It addresses the problematic extent to which the national legal system is sufficient in providing effective protection and deterrence against violations targeting this vulnerable group. The study begins by defining the conceptual framework of disability, its classifications (physical, sensory, and mental), and its causes. It reviews the evolution of the legislator's perspective—from mere social welfare to the establishment of "full citizenship" in alignment with international conventions. The core of the thesis analyzes protection mechanisms, starting with legal privileges such as the right to education, work, health, and accessibility to facilities. It then moves to the stringent penal protection established by the Penal Code and special laws (such as the Anti-Kidnapping Law). The legislator considers "the state of disability" an aggravating circumstance that warrants maximum penalties in crimes such as kidnapping, exploitation in begging, harassment, or physical assault, to compensate for the victim's diminished ability to self-defend.
