dc.description.abstractترتكز الدراسة على جريمة تهريب الآثار في القانون الجزائري، فتناولنا في الإطار المفاهيمي لجريمة تهريب الآثار، تم تناولنا أبرز الأسباب التي تساهم في انتشار جريمة تهريب الآثار،حيث تمت الإشارة إلى علاقة بين تهريب الآثار وجريمة المنظمة وجريمة الاقتصادية، وأبرزت الدراسة الانعكاسات السلبية على الهوية الوطنية والاقتصاد الوطني والصورة الدولية للجزائر، وتم تحليل أركان المادية والمعنوية لجريمة تهريب الآثار وفق ما نص عليها القانون الجزائري، وتطرقت الدراسة إلى آليات الوطنية من أجهزة أمنية وقضائية الناشطة لمكافحة جريمة تهريب الآثار، كما استعرضت جهود التعاون الدولي في المنظمات الدولية المبرمة مع اليونسكو والجزائر. . Abstract: The study focuses on the crime of antiquities smuggling under Algerian law. It begins with a conceptual framework for the crime of antiquities smuggling, addressing the main factors that contribute to its spread. The study also highlights the links between antiquities smuggling, organized crime, and economic crime. It underscores the negative impacts of this crime on national identity, the national economy, and Algeria’s international image. Furthermore, it analyzes the material and moral elements of the crime of antiquities smuggling as defined by Algerian legislation. The study also explores national mechanisms, including active security and judicial bodies, dedicated to combating this crime, and reviews international cooperation efforts, particularly those involving UNESCO and agreements signed with Algeria.
