dc.description.abstractملخص المذكرة : سنتناول في دراستنا هذه و الموسومة بالمحاولة الجنائية في التشريع الجزائري حيث إن العقاب على الجرائم يتطلب وجود نتيجة إجرامية، لأنه في بعض الأحيان يقوم الجاني بكامل نشاطه الإجرامي إلا أنه لا تتحقق فيه النتيجة وهذا ما يسمى بالمحاولة الجنائية. والمحاولة هي أن يبدا الجاني في ارتكاب عمل إجرامي دون تحقق النتيجة ولها نوعين وهما الجريمة الموقوفة والجريمة الخائبة, وتمر بعدة بمراحل منها مرحلة التفكير الى البدء في التنفيذ وللمحاولة ثلاثة أركان متل الجريمة التامة وهي الركن الشرعي, الركن المادي, الركن المعنوي. مما يفرض علينا التطرق إلى نطاق المحاولة في التشريع الجزائري ونتناول فيه الجرائم التي يعاقب على المحاولة فيها وبعدها نطاق المحاولة في الشريعة الإسلامية,واخيرا العقاب على المحاولة في التشريع الجزائري والشريعة الإسلامية summary In our study, we will discuss what is called the criminal attempt in Algerian legislation, as punishment for crimes requires the presence of a criminal result, because sometimes the perpetrator carries out his full criminal activity, but the result is not achieved, and this is what is called a criminal attempt. The attempt is when the perpetrator begins to commit a criminal act without achieving the result. It has two types, namely the stopped crime and the failed crime. It goes through several stages, including the stage of thinking until the beginning of implementation. The attempt has three elements, like the completed crime, which is the legal elementThe material element, the moral element. Which forces us to address the scope of the attempt in Algerian legislation, in which we address the crimes in which the attempt is punishable, then the scope of the attempt in Islamic law, and finally the punishment for the attempt in Algerian legislation and Islamic law
