Abstract
أثناء مباشرة تنفيذ الأحكام القضائية كثيرا ما يواجه الطرف المحكوم له أو المحضر القضائي إشكالات عديدة تعيق مواصلة التنفيذ و تسمى بإشكالات التنفيذ وهي وسيلة قانونية لحماية صاحب المصلحة من أطراف الدعوى ، أو الغير لوقف التنفيذ بطريقة لم تراع فيه الإجراءات القانونية ،وتوجد هناك نوعين من إشكالات التنفيذ و هما إشكالات تنفيذ موضوعية و إشكالات تنفيذ وقتية،فالأولى لا تنشيء أثر توقيف التنفيذ إلا بعد صدور حكم قضائي ، و الثانية بمجرد رفع الدعوى تنشيء أثر توقيف التنفيذو تثور أثناء التنفيذ أو بمناسبة التنفيذ ،و يشترط لقبول دعوى إشكالات التنفيذ توفر شرطي المصلحة و الإهلية،و تعرض على القضاء للفصل فيها بحكم قضائي، وينبغي للمحكمة المعروض عليها النزاع الفصل بصفة إستعجالية حتى لاتصبح إشكالات التنفيذ وسيلة لعرقلة التنفيذ.
Summary
During the implementation of judicial rulings, the ruling party or the judicial record often faces many problems that hinder the continuation of implementation, and they are called implementation problems, and they are a legal means to protect the stakeholder from the parties to the case, or others to stop execution in a way that did not observe legal procedures, and there are two types of implementation problems. They are objective implementation problems and temporary implementation problems. The first does not create the effect of suspending execution except after a judicial ruling is issued, and the second, once a lawsuit is filed, creates the effect of stopping execution and arises during execution or on the occasion of implementation. To accept a lawsuit about execution problems, two conditions of interest and eligibility are required to be accepted. And it is presented to the judiciary for adjudication by a judicial ruling, and the court before which the dispute is submitted must decide in an urgent manner so that implementation problems do not become a means to obstruct implementation.
