| dc.description.abstract | ملخص الدراسة: إن إجراء نزع الملكية للمنفعة العمومية من الوسائل و الطرق الاستثنائية غير العادية للأشخاص العامة لاقتناء الأملاك والحقوق العينية العقارية الخاصة ،لاستعمالها و استغلالها في تنفيد المشاريع ذات الطابع العمومي،فهو امتياز من امتيازات السلطة العامة متى كان ذلك بهدف تحقيق منفعة عمومية أو خدمة مرفق عمومي، ومنه فظهرت نصوص تهدف إلى القيام بعمليات نزع الملكية بصفة شرعية وكذا ضمان حقوق المنزوعة ملكيته، وهذا ما جاء به قانون 91-11 المؤرخ في في27 أفريل 1991 الذي يتناول في مضمونه المبادئ العامة التي تضبط سير عمليات نزع الملكية من أجل المنفعة العمومية و المرسوم التنفيذي رقم 93-186 المؤرخ في 27 جويلية 1993 الذي يحدد كيفيات تطبيقه. summary The procedure of expropriation for public benefit is one of the exceptional and extraordinary means and methods for public persons to acquire property and private real estate rights for use and exploitation in the implementation of projects of a public nature. It is a privilege of the public authority whenever this is done with the aim of achieving a public benefit or serving a public facility, and from it texts emerge. It aims to carry out expropriation operations legally, as well as to guarantee the rights of the expropriated person. This is what was stated in Law No. 91-11 of April 27, 1991, which addresses in its content the general principles that regulate the conduct of expropriation operations for the public benefit, and Executive Decree No. 186-93 of July 27, 1993, which specifies the modalities of its application. | |
