dc.description.abstractالملخص يعتبر موضوع حماية المستهلك في العقد الإلكتروني موضوعا حديثا وهاما للغاية، لذلك سعى المشرع الجزائري إلى سن قوانين تنظيمية لحماية المستهلك في جميع مراحل العقود الإلكترونية نظرا لإعتباره الطرف الضعيف في هذا العقد، إنطلاقا من مرحلة ما قبل التعاقد التي يشترط فيها الإعلام ورضا المستهلك، مرورا إلى مرحلة تنفيذ العقد الذي يتمثل في حمايته من الشروط التعسفية والإذعان وحمايته من خلال بياناته الشخصية وكذلك التوقيع الإلكتروني، وأخيرا الوصول إلى مرحلة ما بعد التعاقد التي تتمثل عند الإخلال بأحد القواعد الحمائية إتجاه المستهلك الإلكتروني في أي مرحلة من مراحل التعاقد توقيع المسؤوليتين المدنية والجزائية على المخالف. Abstract The subject of consumer protection in an electronic contract is a very recent and important topic, so the Algerian legislator sought to enact regulatory laws to protect consumers at all stages of electronic contracts due to being considered the weak party to this contract, starting from the pre-contract stage in which information and consumer satisfaction are required, passing through to the stage of contract execution which civil and criminal penalties for The violator.
