| dc.description.abstract | تتناول هذه المذكرة موضوع تكييف العقد في القانون المدني، باعتباره إجراءً قانونيًا يهدف إلى تحديد الطبيعة الحقيقية للعلاقة التعاقدية وإضفاء الوصف القانوني المناسب لها. ينقسم البحث إلى فصلين؛ الأول يُعالج الإطار المفاهيمي للتكييف، حيث تم التطرق إلى تعريف التكييف، أهميته، أنواعه، وآثاره على الالتزامات العقدية. أما الفصل الثاني فيتناول دور القانون والقضاء في التكييف، من خلال دراسة القواعد والمعايير القانونية، والمنهج القضائي المعتمد في تكييف العقود، مع بيان الصعوبات التي تواجه القاضي أثناء أداء هذه المهمة. تهدف الدراسة إلى بيان أهمية التكييف في حماية الإرادة العقدية وتحقيق التوازن بين أطراف العقد، كما تسعى لتقديم مقترحات عملية لتحسين الإطار القانوني والقضائي الذي ينظّم عملية التكييف This thesis addresses the subject of contract characterization in civil law, as a legal process aimed at determining the true nature of the contractual relationship and assigning it the appropriate legal description. The research is divided into two chapters: the first explores the conceptual framework of characterization, covering its definition, importance, types, and effects on contractual obligations. The second chapter examines the role of law and judiciary in the characterization process, through the study of legal rules and standards, as well as the judicial approach adopted in characterizing contracts, highlighting the challenges faced by judges in performing this task. The study aims to demonstrate the importance of characterization in protecting contractual intent and ensuring balance between contracting parties, while also seeking to propose practical recommendations for improving the legal and judicial framework that governs contract characterization. | |
