dc.description.abstractالملخص: تعد الجرائم البيئية من أخطر الجرائم التي تهدد محيط الإنسان وعلى ذلك سعى المشرع الجزائري في تعزيز النظم القانونية لحماية البيئة وتحديد العقوبات المترتبة عن إلحاق الضرر بالعوامل البيئة سواء في البر، الماء أو الجو، واهم هذه القوانين قانون رقم 03-10 حماية البيئة في إطار التنمية المستدامة، و الذي تناول عدة تنظيمات وإجراءات متعلقة بحماية البيئة و التي حددت مسئولية الشخص الطبيعي والمعنوي والعقوبات المتربة عن التلوث البيئي والمتمثلة في الحبس والغرامات المالية . Les délits de pollution font partie des crimes les plus graves qui menacent l'environnement humain, c'est pourquoi le législateur algérien a souhaité renforcer les systèmes juridiques de protection de l'environnement et déterminer les peines résultant des atteintes aux facteurs environnementaux, qu'ils soient terrestres, aquatiques ou aériens. Et la plus importante de ces lois est la loi n° 10-03 sur la protection de l'environnement dans le cadre du développement durable, qui traitait de plusieurs règlements et procédures liés à la protection de l'environnement, qui déterminait la responsabilité de la personne physique et morale.et les pénalités pour pollution de l’environnement sont des peines d'emprisonnement et des amendes financières. Pollution offenses are among the most serious crimes that threaten the human environment, which is why the Algerian legislator wished to strengthen the legal systems for the protection of the environment and determine the penalties resulting from attacks on environmental factors, which they are terrestrial, aquatic or aerial. In addition, the most important of these laws is Law No. 10-03 on environmental protection within the framework of sustainable development, which dealt with several regulations and procedures related to environmental protection, which determined the responsibility of the natural and legal person. In addition, the penalties for environmental pollution are imprisonment and financial fines.
