| dc.description.abstract | تناولت هذه الدراسة تنظيم حق الإضراب في التشريع الجزائري وفق القانون رقم 23-08 من خلال بيان الإطار القانوني المنظم له ومدى تحقيق التوازن بين حماية حقوق العمال وضمان استمرارية المرافق العامة. كما تطرقت إلى مفهوم الإضراب وطبيعته القانونية والأساس الدستوري الذي يقوم عليه، إضافة إلى أسباب النزاعات الجماعية للعمل. وتناولت الدراسة كذلك الشروط والإجراءات القانونية لممارسة الإضراب، وآليات تسوية النزاعات الجماعية كالصلح والوساطة والتحكيم، مع بيان الآثار القانونية للإضراب المشروع وغير المشروع. وخلصت الدراسة إلى أن المشرع الجزائري اعترف بحق الإضراب كحق دستوري، لكنه أخضعه لضوابط قانونية تهدف إلى حماية المصلحة العامة وضمان السير المنتظم للمرافق العامة. Study Abstract: This study examined the regulation of the right to strike in Algerian legislation under Law No. 23-08, highlighting the legal framework governing this right and the balance between protecting workers’ rights and ensuring the continuity of public services. It also discussed the concept, legal nature, and constitutional basis of the right to strike, as well as the causes of collective labor disputes. The study further addressed the legal conditions and procedures for exercising the right to strike, along with dispute settlement mechanisms such as conciliation, mediation, and arbitration. It also examined the legal effects of lawful and unlawful strikes. The study concluded that Algerian legislation recognizes the right to strike as a constitutional right while subjecting it to legal controls aimed at protecting the public interest and ensuring the regular functioning of public services. | |
