| dc.description.abstract | إن المسؤولية المدنية تتوفر متى توفرت أركانها من خطأ وضرر وعلاقة سببية بينهما، بحيث أن وجود التعويض مرتبط بوجود الضرر، وقد يكون أساس هذه المسؤولية ناتج عن عقد أو عن نصوص قانونية فتنشأ عنه مسؤولية عقدية ومسؤولية تقصيرية. وهنا نستخلص أن المحامي يخضع للمساءلة المدنية،ونجد أيضا أن المحامي كغيره من الأشخاص تترتب عليهم مسؤولية جزائية نتيجة ارتكابه لبعض الجرائم بحيث يلتزم بعدة قيود ما دام منتسب لهاته المهنة بما فيها الواجبات التي يفرضها عليه القانون مما يجعله خاضعا لأحكام عقابية جراء تجاوزاته الجسيمة والجرائم المحتمل ارتكابها من قبله لدى فرض المشرع عقوبات وغرامات مالية. Summary: Civil liability arises whenits constituent elements are present:fault, damage, and a causal linkbetweenthem. Compensation isthereforedependent on the existence of harm. This liabilitymaybebasedeither on a contract or on statutory provisions, givingrise to contractual or tortiousliability. It followsthat a lawyerissubject to civil liability. Moreover, likeanyotherindividual, a lawyermayalsoincurcriminalliability as a result of committing certain offenses. As long as the lawyerremains a member of the profession, they are bound by a set of obligations imposed by law, includingprofessionalduties. Consequently, theymaybesubject to penal sanctions for seriousmisconduct or for crimes theymay commit in the course of theirduties, as the legislator has established penalties and fines in this regard. | |
