| dc.description.abstract | ملخص: الىجانبثبوتالجنسيةللفردمعميلادهوهومايعرفبالنسبةالأصلية،وضعتتشريعاتالجنسيةعلىاختلافهاطرقالاكتسابالجنسيةفيفترةلاحقةعلىميلادالفردوفقضوابطوشروط،لعلأهمهاإكتسابالجنسيةعنطريقالزواجالمختلط،هذهالطريقةالأخيرةالتيتمايزتالقوانينفيبدايةسنهافيتحديدالأفرادالذينيمكنهمالقانونمنالدخولفيهاوذلكعلىأساسالجنس،علاوةعلىالآثارالتييرتبهازواجالمرأةبرجلأجنبيمنآثارغيرعادلةعلىجنسيتهاالتيوصلتالىحدتجريدهامنها،وهوماسعتالمنظومةالقانونيةالدوليةلمحاربته،ومنخلالذلك،تعالجهذهالدراسةأحكامإكتسابالجنسيةبالزواجفيالتشريعالجزائريوالآثارالمترتبةعندخولالأجنبيفيالجنسيةالجزائريةعنطريقهذهالآلية،معتسليطالضوءعلىالتاريخالقانونيلجنسيةالمرأةفيهذاالنوعمنالزواجفيالنظمالقانونيةالمقارنةوالقانونالدولي،لنصلإلىأنالتشريعالجزائريالىجانبأغلبتشريعاتالجنسيةالمعاصرةقداستقرتعلىالمساواةبينالجنسينفىتنظيمأحكامإكتسابالجنسيةبالزواجوحتىالمساواةفينقلهاالىالأبناء Abstract : In addition to nationality being established for an individual at birth, known as original nationality, nationality laws across different jurisdictions have laid out methods for acquiring nationality at a later stage post-birth under certain conditions and requirements. One of the most significant methods is acquiring nationality through mixed marriage. Initially, laws varied in determining which individuals were eligible for this type of nationality acquisition, often based on gender. Furthermore, the marriage of a woman to a foreign man resulted in unfair effects on her nationality, sometimes leading to its loss. The international legal system has endeavored to combat this. This study examines the rules governing the acquisition of nationality through marriage in Algerian legislation and the implications of a foreigner acquiring Algerian nationality via this mechanism. It also highlights the legal history of women's nationality in such marriages within comparative legal systems and international law. The study concludes that Algerian legislation, alongside most contemporary nationality laws, has settled on gender equality in regulating the acquisition of nationality through marriage and even in passing it on to offspring. | |
