| dc.description.abstract | تتناول هذه المذكرة الدراسة التحليلية أهمية الطب الشرعي وعلاقته بجهاز العدالة، مبرزةً مفاهيمه، وضوابط عمله، ومجالات تدخله (المدني، العسكري، الاجتماعي والجنائي). توضح المذكرة دور الخبير الشرعي في كشف الحقيقة من خلال المعاينات والفحوصات والتقارير العلمية، مع التركيز على أهمية الخبرة الشرعية والقيمة القانونية للتقارير الطبية في الإثبات. كما تُسلط الضوء على المسؤوليات الأخلاقية والقانونية المترتبة على عمل الطبيب الشرعي، وتأثيره في توجيه الدعوى الجزائية. وتستعرض المذكرة تطبيقات عملية تشمل إثبات الجرائم، خاصة جرائم القتل والتسميم والاعتداء الجنسي والإجهاض، مبينة كيف يسهم الطب الشرعي في الربط بين الأدلة وتفسير الملابسات الجنائية بدقة علمية. وختاماً، تؤكد المذكرة أن الطب الشرعي أداة فنية ضرورية في خدمة العدالة الجنائية، يتعين اعتمادها إلى جانب الأدلة الأخرى. Abstract : This thesis presents an analytical study of the importance of forensic medicine and its relationship with the justice system, highlighting its concepts, work regulations, and fields of intervention (civil, military, social, and criminal). It explains the role of the forensic expert in uncovering the truth through examinations, analyses, and scientific reports, with a focus on the value of forensic expertise and the legal weight of medical reports in criminal evidence. The study also sheds light on the ethical and legal responsibilities of forensic doctors and their influence on criminal proceedings. Practical applications are reviewed, particularly in proving crimes such as murder, poisoning, sexual assault, and abortion, showing how forensic medicine contributes to linking evidence and scientifically interpreting criminal circumstances. In conclusion, the thesis affirms that forensic medicine is a vital technical tool in the service of criminal justice and must be considered alongside other forms of evidence. | |
