| dc.description.abstract | تسعى هذه الدراسة إلى تحليل عقد الامتياز كآلية قانونية لتعبئة وتسيير العقار السياحي في الجزائر، ومدى مساهمته في دعم الاستثمار السياحي وتحقيق التنمية الاقتصادية المحلية. وقد انطلقت الدراسة من إشكالية مفادها: إلى أي مدى يُعد عقد الامتياز آلية فعالة في تعبئة واستغلال العقار السياحي لتحقيق التنمية السياحية في الجزائر؟، مع طرح أسئلة فرعية حول الإطار القانوني، شروط المنح، التحديات، ومدى مساهمته في تطوير القطاع. استخدم الباحثون المنهج الوصفي التحليلي من خلال تحليل النصوص القانونية والتنظيمية ذات الصلة، مع ربط الجانب القانوني بالبعد الاقتصادي والإداري. وخلصت الدراسة إلى أن عقد الامتياز يشكل أداة فعالة لتخصيص العقار السياحي، لكن تعترضه تحديات كبيرة، أبرزها تعقيد الإجراءات الإدارية، غياب التنسيق بين الجهات، وصعوبة التمويل. وأوصت الدراسة بإصلاح الإطار التشريعي وتفعيل دور الهيئات المختصة لتحفيز الاستثمار السياحي وتثمين العقار العام. This study aims to analyze the concession contract as a legal mechanism for mobilizing and managing tourism-related land in Algeria, and to what extent it contributes to supporting tourism investment and achieving local economic development. The research is based on the central question: To what extent is the concession contract an effective tool for mobilizing and exploiting tourism land to achieve tourism development in Algeria? Sub-questions were also raised regarding the legal framework, granting conditions, challenges, and the contract’s role in advancing the sector. The researchers adopted the descriptive and analytical method, by examining relevant legal and regulatory texts while linking legal dimensions with economic and administrative considerations. The study concluded that the concession contract is an effective tool for allocating public land for tourism purposes, yet it faces significant challenges, including complex administrative procedures, lack of coordination among stakeholders, and financing difficulties.
