| dc.description.abstract | رغم التطور المتسارع للذكاء الاصطناعي، لاتزال المنظومة القانونية في الجزائر تواجه تحديات جوهرية في استيعاب تأثيراته على الأمن القانوني. تسلط هذه الدراسة الضوء على العلاقة بين التحول الرقمي واستقرار المعاملات القانونية والاقتصادية، من خلال تحليل مدى قدرة الإطار القانوني الحالي على التكيف مع المستجدات الرقمية، وقد بينت الدراسة أن الاعتماد المتزايد على الذكاء الاصطناعي، خصوصًا في القرارات الاستثمارية والعقود الإلكترونية، يفرض إعادة تقييم القواعد التقليدية التي قد لا تواكب طبيعة المعاملات الرقمية الحديثة. وعليه، تبرز الحاجة إلى نهج تشريعي أكثر تطورًا ومرونة، يوازن بين تعزيز الابتكار التكنولوجي وضمان استقرار القواعد القانونية وحماية الحقوق المشروعة للأطراف المتعاملة. Despite the rapid advancement of artificial intelligence, the legal system in Algeria still faces fundamental challenges in comprehending its impact on legal security. This study sheds light on the relationship between digital transformation and the stability of legal and economic transactions, by analyzing the extent to which the current legal framework can adapt to digital developments. The study reveals that the growing reliance on artificial intelligence—particularly in investment decisions and electronic contracts—necessitates a reassessment of traditional legal rules, which may not keep pace with the nature of modern digital transactions. Accordingly, there is a pressing need for a more advanced and flexible legislative approach that balances the promotion of technological innovation with the stability of legal norms and the protection of the legitimate rights of contracting parties. | |
