dc.description.abstractتناولت هذه الدراسة موضوع المسؤولية الجنائية للطبيب ، اعتمدنا على المنهج الوصفي في الدراسة للوصف الدقيقلمفهوم العمل الطبي و المسؤولية الجنائية لطبيب وبعض الجرائم التي يرتكبها الطبيب منها الجسدية والمهنية ،كما استخدمنا المنهج التحليلي وذلك من خلال تحليل النصوص القانونية والتعرف على الأساس القانوني لكل من العمل الطبي و المسؤولية الجنائية للطبيب و أخيرا العقوبات المقررة للجرائم المرتكبة من طرف الطبيب ،توصلنا من خلال الدراسة إلى أن يمكن تقرير المسؤولية الجنائية إلا إذا توافرت علاقة سببية بين الخطأ والضرر ،على ضوء دراستنا نقترح وضع لجان للتقصي والتحري عن الأخطاء الطبية و دراستها حتى لا تتكرر مستقبلا. This study addressed the topic of criminal liability of the doctor. We relied on the descriptive approach in the study to accurately describe the concept of medical work and criminal liability of the doctor and some crimes committed by the doctor, including physical and professional crimes. We also used the analytical approach through analyzing legal texts and identifiant the légal basis for Bothe médical work and criminal liability of the doctor and finally the penalties prescribed for crimes committed by the doctor. Through the study, we concluded that criminal liability can only be determined if there is a causal relationship between the error and the damage. In light of our study, we propose establishing committees to investigate and investigate medical errors and study them so that they arenot repeated in the future.
