| dc.description.abstract | الملخص: إن الالتزامات في عملية تنفيذها تتطلب أن تنفذ عينا وهو الأصل، أي أن يقوم المدين بتنفيذ ذات ما التزم به والمتفق عليه وفي العقد. ومن شروط تحقيق التنفيذ العيني لهذا الالتزام لابد أن يكون هذا التنفيذ ممكنا أضافة الى ذلك الا يكون مرهقا المدين وعلى الدائن إعذاره والا يكون فيه مساسا بالحرية الشخصية المدين، والتنفيذ العيني للالتزام يكون إما قيام المدين بعمل أو للامتناع عنه أو بإعطاء شيء أما بخصوص ضمانات حق الدائن تتمثل في الدعوى المباشرة وغير المباشرة. ولتنفيذ هذا الالتزام أورد المشرع الجزائري نصوصا قانونية تنص عل وسائل التنفيذ العيني للالتزام فهناك ماهي مباشرة وأخرى غير مباشرة كالغرامة التهديدية.
