| dc.description.abstract | ملخص الدراسة باللغة العربية: قوانين التجارة لا تقتصر علىالعمليات التجارية فقط، بل تشمل أيضًا تنظيم شروط اكتساب صفة التاجر والتزاماته، بموجب هذه القوانين، يتوجب على الأفراد الذين يكتسبون صفة التاجر الالتزام بالشروط المحددة والقيود المفروضة عليهم، وذلك لضمان النزاهة والشفافية في الممارسات التجارية وحماية حقوق المستهلكين وتجنب المنافسة غير المشروعة، حيث هدفنا من خلال هذه الدراسة إلى تسليط الضوء على صفة التاجر وتحليل مختلف التزاماته المهنية بغية ابراز سياسة المشرع الجزائري في تنظيم الممارسات التجارية وتوضيح القوانين واللوائح التي تحدد هذه الالتزاماتوفهم كيفية تطبيقها. اعتمدنا لمعالجة هذا البحث على المنهج التحليلي والوصفي ومن أهم النتائج المتوصل إليها أنه يفرض على التاجر مسك الدفاتر التجارية والقيد في السجل التجاري وهي التزامات أساسية لضمان استمرارية الأعمال التجارية وتعزيز النزاهة والشفافية. Trade laws are not limited to commercial operations alone; they also include the regulation of conditions for acquiring the status of a merchant and their obligations. According to these laws, individuals who acquire merchant status must adhere to specific conditions and imposed restrictions to ensure integrity and transparency in commercial practices, protect consumer rights, and avoid unfair competition. This study aims to highlight the status of merchants and analyze their various professional obligations to showcase the Algerian legislator's policy in regulating commercial practices and clarify the laws and regulations that define these obligations and understand how they are applied. We adopted an analytical and descriptive approach to address this research. Among the most important findings is that merchants are required to keep commercial books and register in the commercial register, which are essential obligations to ensure the continuity of business activities and promote integrity and transparency. | |
