dc.description.abstractالملخص: استهدفت دراستنا تسليط الضوء على الآليات الوقائية والردعية وفقا للأمر الرئاسي رقم 20/03 المؤرخ في 20 أوت 2020 المتعلق بالوقاية من عصابات الأحياء ومكافحتها عبر تجهيز ترسانة قانونية تعمل على دحض كافة أشكال الإجرام الذي من الممكن أن يرتكبه المتورطون اتجاه الأفراد، وقد تم اعتماد في دراستنا على المنهج الوصفي التحليلي عبر إخضاع النصوص القانونية لقراءة معقمة واستنباط الآليات والاستراتيجيات التي من الممكن أن تكون الحل في إعادة الأمان في أوساط السكنية ، كما تم تشديد المشرع بشأن تشكيل عصابات الأحياء بحيث اشترط لقيامها تعدد الجناة الذين لا يقل عددهم عن شخصين وقد خلصت نتائج دراستنا إلى نقطة مفادها انتباه المشرع الجزائري إلى خطورة ظاهرة عصابات الأحياء مما جعله يفردها بقانون خاص. Abstract: Our study aimed to highlight the preventive and deterrent mechanisms in accordance with Presidential Decree No. 20/03, dated August 20, 2020, related to the prevention and combating of neighborhood gangs through the preparation of a legal arsenal that works to refute all forms of criminal activities that may be committed by individuals involved in these gangs. We relied on a descriptive-analytical approach in our study by subjecting the legal texts to a meticulous reading and deducing the mechanisms and strategies that could be the solution to restoring security in residential environments. The legislator has also placed emphasis on the formation of neighborhood gangs, stipulating that they require the involvement of multiple offenders, with a minimum number of two individuals. The results of our study have led to the conclusion that the Algerian legislator has given attention to the danger of neighborhood gangs, which prompted them to address it with a specific law.
