Abstract
يولي المشرع الجزائري اهتمامًا خاصًا بالمرأة العاملة من خلال توفير حماية قانونية شاملة تنطلق من اعتبارات أخلاقية واجتماعية وقانونية متعددة، وقد خصّ القانون الجزائري المرأة بمجموعة من الحقوق المميزة التي لا تشاركها فيها الفئات المهنية الأخرى، ومن أبرزها منع تشغيلها في العمل الليلي والأعمال الخطيرة، بالإضافة إلى منحها الحق في إجازة الأمومة مدفوعة الأجر وساعات مخصصة للإرضاع، تعكس هذه الأحكام التزام المشرع الجزائري الراسخ بضمان الحماية اللازمة لهذه الشريحة المهمة من القوى العاملة.
وقد تطور الإطار التشريعي الجزائري المتعلق بحماية المرأة العاملة تطورًا ملحوظًا، وذلك بالتوازي مع تنامي الوعي المجتمعي بالدور الحيوي للمرأة كعنصر محوري في النهوض بالاقتصاد الوطني، كما ساهم إنشاء مؤسسات متخصصة مثل المجلس الوطني للمرأة والمجلس الوطني لحقوق الإنسان في تعزيز هذا التوجه الحمائي وتطوير آلياته.
Abstract:
The Algerian legislator pays special attention to workingwomen by providingcomprehensivelegal protection based on multiple ethical, social, and legalconsiderations. Algerian law has grantedwomen a set of distinctive rightsthat are not sharedwithotherprofessionalcategories, mostnotably the prohibition of night work and hazardous occupations, in addition to grantingthem the right to paidmaternityleave and designatedbreastfeedinghours. These provisions reflect the Algerian legislator'sfirmcommitment to ensuring the necessary protection for this important segment of the workforce.
The Algerian legislativeframeworkconcerning the protection of workingwomen has undergoneremarkabledevelopment, in parallelwith the growingsocietalawareness of women's vital role as a pivotal element in advancing the national economy. The establishment of specialized institutions such as the National Council for Women and the National Council for Human Rights has alsocontributed to strengtheningthis protective approach and developingitsmechanisms.
