| dc.description.abstract | تهدف هذه المذكرة الى الإطار القانوني والإداري لحماي أراضي الدولة في الجزائر ، وتسليط الضوء على القانون المستحدث رقم 18-23 المؤرخ في 28نوفمبر 2023 ، والذي أقره المشرع الجزائري كإجراء ردعي لوقف التعدي على أراضي الدولة والتصدي لها . تتوزع هذه الدراسة على ثلاث محاور رئيسية ، المحور الأول يعرف أراضي الدول ويعرض الخلفية التشريعية ، الثاني يستعرض آليات الحماية القانونية الوقائية الإدارية والقضائية ، التي أقرها المشرع الجزائري ـ أما الثالث فيناقش التحديات والصعوبات التي تواجه تطبيق القانون مع اقتراح حلول عملية لتكريس حماية فعالة ، حيث خلصت المذكرة أن فعالية هذا القانون مرهونة بمدى الالتزام بالتنفيذ الميداني ، وضرورة التنسيق بين مختلف الفاعلين وتحديث اليات الرقابة والمتابعة . Abstract: This thesis addresses the legal and administrative framework for state lands in Algeria, with a focus on Law No. 23-18 dated November 28, 2023. It sheds light on the legal mechanisms adopted by the Algerian legislator as preventive measures to halt illegal encroachments on state lands and to confront such transgressions.The study is divided into three main axes: the first addresses the concept of state lands and the various types of illegal occupation; the second examines the administrative and judicial protection mechanisms established by the Algerian legislator; while the third discusses the challenges and obstacles facing the effective implementation of these protection mechanisms. The thesis concludes with a set of recommendations to enhance the enforcement of the law through the commitment of the relevant authorities and the formulation of effective preventive and deterrent measures. | |
