Abstract
المسؤولية الجنائية للطبيب تعد من المواضيع الحيوية في القانون نظرا لتداخلها بين حماية حقوق المرضى وضمان حرية الطبيب في أداء مهامه, وتتأسس هذه المسؤولية على وقوع خطا مهني من الطبيب يؤدي الى ضرر للمريض, مع وجود علاقة سببية بين الخطأ والضرر , كما يعد الخطأ الطبي السبيل الى المسؤولية الجنائية والدي يعتبر بدوره احد اهم اركان المسؤولية الطبية ,وقد عالج المشرع هذه الأخطاء بسن قوانين في المجال الطبي استنادا الى قواعد قانون العقوبات وقانون الصحة وتعد مرجعية أساسية في هذا المجال وهذا ما تطرقنا اليه في بحثنا هذا بتعريف الخطأ الطبي, وتعريف المسؤولية الجنائية للطبيب واركانها وقد بيننا الأفعال والجرائم التي يرتكبها الطبيب وتحقق المسؤولية الجنائية والعقوبات المقررة لها وانهينا البحث بخاتمة فيها اهم النتائج التي توصلنا اليها واهم الاقتراحات والتوصيات حول المسؤولية الجنائية للطبيب .
Criminal Responsibility of the Doctor is considered one of most sensitive legal topics due to its intersection between protecting patients’ rights and ensuring the doctors freedom in performing their duties. This responsibility arises from a medical error committed by the doctor that causes harm to the patient, provided that a causal relationship exists between the error and the resulting harm. Medical error represents the primary basis for establishing Criminal responsibility and isconsidered one of its fundamental pillars.
Legislator has addressed such errors through laws governing medical practice, primarily based on the penal Code and the Health law, which serve as key legal reference in this domain.
In this study, we explored the definition of medical error and the criminal responsibility of the doctor, including its components and the associated penalties. We also examined how criminal responsibility is established and the penalties prescribed for such violations. The study concludes with key findings and recommendations concerning the criminal responsibility of doctors.
