dc.description.abstractالملخص عملت معظم التشريعات بما فيها المشرع الجزائري على مكافحة الشروط التعسفية في العقود، وقد عالج البحث بالتحليل إشكالية مدى كفاية الآليات القانونية والمؤسساتية التي كرسها المشرع لمكافحة الشروط التعسفية وإعادة التوازن العقدي، وللإجابة عن ذلك تم اتباع المنهج الوصفي والمنهج التحليلي لإبراز وتحديد الآليات القانونية وتحليل النصوص القانونية التي نظمتها، حيث تم تقسيم خطة البحث إلى فصلين، الفصل الأول بعنوان الآليات القانونية والفصل الثاني بعنوان الآليات المؤسساتية، وقد خلص البحث إلى أن المشرع الجزائري تجاوز عدم كفاية أحكام القانون المدني في مكافحة الشروط التعسفية باعتناقه للنظرية الحديثة في حماية المستهلك، ولكنه سهى عن إيراد جزاء مدني للشرط التعسفي ضمن أحكام منظومته القانونية لذلك يقترح قيام المشرع بالنص على البطلان المطلق للشرط التعسفي. ABESTRECT Most legislation, Including the Algerian legislator, has worked to combat arbitrary conditions in contracts, and the research was addressed by analysing the problem of the adequacy of legal and institutional mechanisms that the legislator has devoted to combating arbitrary conditions and restoring the nodal balance, and to answer this, the descriptive approach and the analytical approach to highlighting and identifying legal mechanisms and analysing legal texts was followed it was organized, where the research plan was divided into two chapters, the first chapter entitled legal mechanisms and the second chapter entitled institutional mechanisms, and the research concluded that the Algerian legislator exceeded the insufficient civil law in combating arbitrary conditions by converting to modern theory in consumer protection, but it is easy for revenue a civil penalty for the arbitrary condition within the provisions of his legal system, so it suggests that the legislator stipulate the absolute nullity of the arbitrary condition.
