ملخص:
جاء المرسوم الرئاسي 15-247 المتضمن تنظم الصفقات العمومية وتفويضات المرفق العام، بنظام اللجنة الموحدة للرقابة الداخلية تحت مسمى "لجنة فتح الأظرفة وتقييم العروض"، وأعطى للمصلحة المتعاقدة سلطة إنشائها وإعداد نظامها الداخلي، مع تحديد اختصاصاتها في مرحلتي الفتح والتقييم، غير أن أعمالها مقيدة بالتنظيم والتشريع المعمول بهما في مجال الصفقات العمومية، وعليه ونظرا لمساهمتها الفعالة في إعداد وإبرام الصفقات العمومية ومساهمتها في حماية المال العام عن طريق هذه الرقابة القبلية، حدد القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته مجموعة من العقوبات تسلط على أعضائها إذا ما خالفوا الأحكام التنظيمية والتشريعية، خاصة مبادئحريةالوصولللطلباتالعمومية، المساواةفيمعاملةالمترشحينوشفافيةالإجراءات، هذه المخالفات يمكن أن تتمثل في جرائم الامتيازات غير المبررة أو جرائم الرشوة في مجال الصفقات العمومية وما يدخل في حكمهما.
The Presidential Decree N. 15-247, which regulates public transactions and public utility mandates, comes with the system of the Unified Committee for Internal Control under the name “Committee for Opening Envelopes and Evaluating Bids”, and gives the contracting authority the right to establish and prepare its internal system while defining its terms of reference in the opening and evaluation phases. Though, its business is restricted by the regulation and legislation implemented in the field of public procurement, and accordingly, in view of its effective contribution to the preparation and conclusion of public procurement and its contribution to the protection of public money through this tribal control. It was surrounded by law 06-01 related to the prevention and control of corruption with a set of penalties imposed on members if they violate the regulatory and legislative provisions, particularly the freedom principles of access to public requests, equality in the treatment of candidates and transparency of procedures.
