dc.description.abstractالملخص لقد مكنت الاساليب الطبية المستحدثة في مجال الطب وعلومه من إنقاذ الكثير من المرضى ذوي الحالات المستعصية على الطب التقليدي، من خلال نقل وزرع الاعضاء من الاموات الى الاحياء، غير أنها في نفس الوقت اثارت العديد من النقاشات الفقهية والقانونية. وقد خلص البحث الى جواز إجراء هذه العمليات إذا ما توفرت مجموعة من الضوابط والشروط القانونية، والتي تضمن الحماية لأطراف هذه العلاقة Abstract : New medical methods in the field of medicine and its sciences have made it possible to save many patients with conditions that are intractable to traditional medicine, through the transfer and transplantation of organs from the dead to the living, but at the same time they have raised many jurisprudential and legal debates. The research concluded that it is permissible to conduct these operations if a set of legal controls and conditions are available, which guarantee protection for the parties to this relationship.
